RESPONSE TO OUR CAMAPIGN AGAINST NFRA: SMS SENT TO CC MEMBERS: COMMENTS OF NEWLY ELECTED CC MEMBER SH. Jay Chhaira IN RESPONSE TO SMS SENT TO HIM:"Sir, NFRA is an ATTACK ON OUR PROFESSION..Bcoz it has been proposed before our team took up. We after taking charge on 12th will immediately and sincerely take it...."
COMMENTS OF PAST PRESIDENT SH. AMARJEET CHOPRA IN RESPONSE TO SMS SENT TO HIM:

"I am NOT VERY OPTIMISTIC given the present state of affairs. But I am a born optimist and feel that if in next 15 days we SHOW URGENCY OF PURPOSE, CONCENTRATE on POLITICIANS; we may SUCCEED. ..

OUR VIEWS:

I agree with Chopra Ji's comment. But question is who will "SHOW URGENCY OF PURPOSE, CONCENTRATE on POLITICIANS"......a common member of the ICAI or the elected representatives of these common members, in the highest body of ICAI i.e.Central Council, called CC members.

AS a common member we have concern towards NFRA and we are appealing to our elected representatives, to take up the matter by making calls to them, by sending SMS, and by way of writing mails. Even we are using social media for that purpose. A common member can join them in protest call, make them aware of the political links......but initiative/remedial action shall be taken from the top.

If as a common member.we approach an MP and he asks us who are you and why not your ICAI President/VP, came to us ,what we will reply...............

NO DOUBT TASK IS DIFFICULT BUT NOT IMPOSSIBLE.....NEED OF THE HOUR IS COMMITMENT OF THE CC MEMBERS TOWARDS THE PROFESSION,FIRM DETERMINATION AND WILL POWER TO ACT...............

APPEAL:
PLEASE MAKE MORE AND MORE MAILS, SMS, EMAILS TO OUR ELECTED REPRESNTATIVES TO MAKE THEM SERIOUS TOWARDS NFRA.....EVERY POLITICIAN HAS A CHARTERED ACCOUNTANT....WHERE IS THE PROBLEM IN MUSTERING POLITICAL SUPPORT.............ONLY THING IS FIRMNESS, DETERMINATION AND WILLING POWER...............

DATED: 04-02-2013

Dear Sir,

Subject:  NFRA –CAUSE OF GRAVE CONCERN. REQUEST TO GIVE MEMORANDUM/PROPER ACTION TO SAFEGAURD ICAI INTEREST

Dear Sir,

As you might be aware new Companies Bill, which has been tabled in the Parliament contains clause of creating "National Financial Reporting Authority(NFRA) for usurp the two big powers of ICAI (a) to set accounting standards and (b) take disciplinary action against its 200,000 members.

We request you to kindly accord top priority to the matter and make representation to the President of ICAI, on behalf of the Branch, for discrimination of the Government against the members of ICAI. Why such a watchdog only for ICAI and not for other professional bodies like MCI(Medical Council of India), Bar Council of India , ICSI and against Institute of Cost Accountants of India.

Once the powers goes to NFRA, it will become an oversight body with quasi-judicial powers and supersede ICAI. Any decision taken by ICAI can be reversed /cancelled or advanced by NFRA.

Every ICAI member will be vulnerable to be charged/ prosecuted by NFRA on complaints made a common person or corporate entity. Anything that goes into reporting of financial statements, this body will oversee the quality, the kind of work they are doing and any complaints... NFRA can even debar them

Please make appropriate representation to the President/Vice President/CC/RC members of ICAI  to safeguard the ICAI interest.

WRITE MAILS, SEND SMS....WRITE ON SOCIAL MEDIA....DO WHAT EVER U CAN DO............
Thanking You,

Yours truly,

We had received the data on tax audit reports e-filed during 2011-12 to ascertain the misuse of membership numbers. Consequently, we recently submitted the details of fake and deceased memberships to the CBDT for appropriate action. We have reported that 652 membership numbers quoted by the assessees in e-returns do not subsist at all. Also, 2,503 tax audits  have been conducted using the fake membership. 311 out of 652 membership numbers belong to the  deceased who passed away before 31-3-2011. 759 out  of 2,503 tax audits were conducted using the identity  of the deceased members.

Fwd: dice are thrown; odds in whose favour - probability of VP of ICAI - from Western India Regional Council

Subject: dice are thrown; odds in whose favour - probability of VP of ICAI - from Western India Regional Council
To:

Dear All

I have collected opinions from various quarters and submitting my analysis to you without bias

  • Out of 11 candidates from west,  5 are new faces and thus am excluding them
  • Out of balance 6, 3 are in 2nd term and 3 are in final term.
  • Adukia,  Sanjeev Maheshwari & Pankaj Jain are in final term / Nilesh, Dhinal & Zaware are in Second term
  • It is expected that all the 6 will try their luck

Pankaj Jain
  • Am told, he is too frank, too straight forward and too blunt
  • How can I expect the political personalities vote to such a person and therefore feel he may not get elected to VP position
  • However, he has a chance if second, third preferences are in his favour and in fray till those are counted, subject to my comments elsewhere
Nilesh
  • Is a Gujarati - if anti Marwadi forces join hands, this factor helps
  • Is related to previous President, Kamlesh
  • Is considered to be in the team opposite of Subodh
  • Is part of MAFIA and thus other MAFIA'ns should support
  • Non controversial
  • Unlike most of the other Council members is an expert in Accountants & audit - am sure this can be added advantage because in politics subject knowledge is never a factor
  • Am told believes in process in every matter - when the Council is known for violation of every process, even this factor is negative for the voters

Dhinal
  • Is from MAFIA - one of the Big Four
  • Is a Gujarati
  • Tech savoy
Zaware
  • Am sure, is the senior most in age
  • Prefers to be in the Council for 1 more term, to protect his business interests
  • may contest for namesake
Sanjeev Maheshwari
  • Close to Subodh
  • Non-controversial
  • Acceptable to most of the voters
  • He is a Marwadi
  • You will generally here from him - "there are 2 sides of a coin"
  • Many analysts are zeroing on this man

Adukia
  • Senior most Council member
  • Shares Knowledge with members ( few critics say not his own knowledge but even if the knowledge is not his original, after all he shares is a great virtue is my answer)
  • In ICAI politics from 1992, if my memory is right i.e spent more than 2/3 of his professional life as elected member in RC & CC
  • Is a Marwadi and that too Agarwal. In the newly constituted Council, if these factors work, he should get quota at the first count itself - adukiaji please insist for open counting and declaring the transfer of votes etc
  • Most of the members in Hyderabad told me they will give first preference to Adukia and second to me in the just concluded central council elections.....am sure he can get elected to Council by contesting from any of the regions
  •  Finally, if not made President in this term, will come back to Council after a gap is worry of many Council members & Council aspirants is why they want Adukia to be President in this term so that in his life he will not come to Council again

Note:  - Our JV,  from South, that too from Hyderabad may kill aspirations & chances of these above persons is my gut feeling as JV is desperate in becoming VP this year and JV's aspirations and chances are in the hands of Devanna & Babu

The above opinions are collected from various members and put in at one place by me

Will email about other regions, after collecting data & info

The RBI had imposed penalties on 19 commercial banks for contravention
of various instructions issued by the central bank in respect of
derivatives such as failure to carry out due diligence in regard to
suitability of products and selling derivatives products to users not
having risk management policies
New Delhi: The Reserve Bank of India (RBI) has imposed penalties on 19
commercial banks, including SBI, HDFC Bank, ICICI Bank and Citibank,
for violating norms on derivatives, reports PTI.
The RBI has informed that it had imposed penalties on 19 commercial
banks on 26 April 2011, for contravention of various instructions
issued by RBI in respect of derivatives such as failure to carryout
due diligence in regard to suitability of products and selling
derivatives products to users not having risk management policies,
minister of state for finance Namo Narain Meena said in a written
reply in the Rajya Sabha.
RBI has issued show-cause notices to banks. In response to this, banks
submitted their written replies, he said.
"On a careful examination of the banks' written replies and the oral
submissions made during the personal hearings, the RBI found that the
violations were established and the penalties were thus imposed," he
said.
While a fine of Rs15 lakh each was slapped on Axis Bank, Barclays,
HDFC Bank, ICICI Bank, Kotak Mahindra and Yes Bank, Rs10 lakh each was
imposed on Citibank, BNP Paribas, SBI, Credit Agricole -CIB,
Development Credit Bank, ING Vysya Bank, Royal Bank of Scotland and
Standard Chartered Bank, he said.
Besides, a fine of Rs5 lakh each was slapped on Bank of America, DBS
Bank, Deutsche Bank, HSBC and J P Morgan Chase Bank, he added.
Mr Meena also said that RBI has informed that the estimated loss of
Rs33,000 crore in the foreign exchange derivative transaction may not
be the actual losses but the gross Market to Market (MTM) gains or
losses to the customers.
MTM gains or losses are basically an accounting concept wherein the
financial institutions would record the value of outstanding financial
contracts at fair value while preparing financial statements, he added

It gives me immense pleasure to inform you that for the first time in India, two pioneers of Commerce and Accountancy education namely the Institute of Chartered Accountants of India (ICAI) and University of Madras have joined hands by entering into an MoU to promote commerce education to the highest level and to contribute towards nation building.

NEWS CAS

The Supreme Court on Wednesday ruled that no immunity from prosecution
can be granted to the members or nonmembers of the Institute of
Chartered Accountants of India for their professional misconduct under
the provisions of the Chartered Accountants Act, 1949.

Such provisions cannot override the penal laws, said apex court setting
aside the order of the Madhya Pradesh HC.

The object underlying the prohibition contained in section 28
(Chartered Accountants Act) is to protect the persons engaged in
profession of chartered accountants against false and untenable
complaints from dissatisfied litigants and others. However, there is
nothing in the language of the provisions contained in chapter VII from
which it can be inferred that Parliament wanted to confer immunity upon
the members and nonmembers from prosecution and punishment if the
action of such member or nonmember amounts to an offence under the IPC
or any other law , said a bench comprising Justice GS Singhvi and
Justice AK Ganguly.
