Order of Bombay High Court relating to Appointment of Auditor of non-aided Societies.

DEAR MEMBER,

An important decision of Bombay High Court


The order dt.06-10-2010 passed in W.P.No.1206 of 1997 filed by MAHARASHTRA CERTIFIED AUDITOR’S ASSOCIATION; the Hon'ble Bombay High Court has held that impugned Govt. Circular dt.11-11-1996 ( which gave powers to the Registrar to appoint statutory auditors for  urban credit/employees co.op. credit societies)  is not applicable  to the non-aided co.operative societies of any category. As a result of this Judgment, henceforth the non-aided employees staff credit/ urban credit societies can appoint auditors of their choice in their AGM/SGM etc.
I've believe that, this decision has both positive and negative aspects considering the existing system of allotment of audit by registrar of Co-op. Societies.

The Supreme Court on Wednesday ruled that no immunity from prosecution
can be granted to the members or nonmembers of the Institute of
Chartered Accountants of India for their professional misconduct under
the provisions of the Chartered Accountants Act, 1949.

Such provisions cannot override the penal laws, said apex court setting
aside the order of the Madhya Pradesh HC.


The object underlying the prohibition contained in section 28
(Chartered Accountants Act) is to protect the persons engaged in
profession of chartered accountants against false and untenable
complaints from dissatisfied litigants and others. However, there is
nothing in the language of the provisions contained in chapter VII from
which it can be inferred that Parliament wanted to confer immunity upon
the members and nonmembers from prosecution and punishment if the
action of such member or nonmember amounts to an offence under the IPC
or any other law , said a bench comprising Justice GS Singhvi and
Justice AK Ganguly.

Can you circulate this around especially as Xmas is fast approaching it has been confirmed by Royal Mail. The Trading Standards Office are making people aware of the following scam:

A card is posted through your door from a company called PDS (Parcel Delivery Service) suggesting that they were unable to deliver a parcel and that you need to contact them on 0906 6611911 (a Premium rate number).

DO NOT call this number, as this is a mail scam originating from Belize .

If you call the number and you start to hear a recorded message you will already have been billed £315 for the phone call.

If you do receive a card with these details, then please contact Royal Mail Fraud on 020 7239 6655.
